RETURN & CANCELLATION POLICY

1. Scope and General Principles

Due to the specialized and high-performance nature of our products, return rights are limited to the extent permitted by applicable law.

Nothing in this policy limits mandatory statutory rights of consumers under applicable consumer protection laws.

Unless legally required otherwise, all sales are considered final.

We do not offer a voluntary 30-day return policy.

2. Statutory Right of Withdrawal (EU Consumers)

If you qualify as a consumer under EU law, you have the statutory right to withdraw from the contract within 14 days from the day you receive the goods, unless a legal exception applies.

To exercise your right of withdrawal, you must inform us in writing within 14 days of delivery:

You must return the goods within 14 days after notifying us.

The customer bears the direct cost of returning the goods unless mandatory law provides otherwise.

Refunds will be processed within 14 days after receipt and inspection of the returned goods.

We may withhold reimbursement until the goods have been received and inspected.

3. Exclusion of Withdrawal – Custom and Made-to-Order Products

Pursuant to Article 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply to goods:

• manufactured according to customer specifications

• clearly personalized

• individually configured

• built-to-order

• performance-modified upon request

For such Custom Products:

• Production may begin immediately after order confirmation.

• Once production has started, cancellation is excluded.

• No return or withdrawal is possible where legally permitted.

By placing an order for a Custom Product, the customer expressly acknowledges this exclusion.

4. Motorsport and Racing Products

Many products offered by MCE Performance are intended exclusively for racing, competition, or off-road use.

Such products:

• may not comply with road traffic regulations

• may void vehicle registration or type approval

• may invalidate insurance coverage

Returns based on:

• lack of road approval

• failed inspection

• incompatibility with local regulations

• racing disqualification

• regulatory restrictions

are excluded.

The customer is solely responsible for verifying legal compliance prior to purchase.

5. Conditions for Eligible Returns (Non-Custom Goods Only)

If the statutory right of withdrawal applies, returned goods must:

• be unused

• not installed or mounted

• not modified

• not exposed to operational or racing stress

• be in original packaging

• be in resalable condition

• include proof of purchase

Installed, tested, mounted, activated, or used motorsport components are not eligible for return.

The customer is liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

6. Non-Returnable Items

The following items are excluded from return where legally permitted:

• Custom Products

• Performance-modified components

• Built-to-order parts

• Clearance and sale items

• Gift cards

• Special procurement items

• Hazardous materials

• Flammable liquids

• Activated electronic control units

• Software, digital files, ECU calibrations

• Sealed technical components once unsealed

7. Inspection and Defects

The customer must inspect goods immediately upon delivery.

Visible transport damage must be reported within 48 hours.

Normal wear, racing wear, improper installation, overheating, over-revving, mechanical overstress, or misuse do not constitute defects.

Warranty claims are governed exclusively by our Terms and Conditions.

8. Exchanges

We do not offer direct exchanges.

If a return is approved, a new order must be placed separately.

9. Refund Processing

Approved refunds will be issued using the original payment method.

Shipping costs are non-refundable unless required by mandatory law.

Transaction fees charged by payment providers may be deducted where legally permitted.
